Email Disclaimer

PEKA Professional Property Management Ltd. (“PEKA”), on behalf of the Condominium Corporation in which you are a member, have agreed to offer email as a distribution method to owners in accordance with the passing of the Condominium Property Amendment Act.

By agreeing to receive condominium correspondence via email, you acknowledge, agree and consent to the following:

  • Condominium correspondence can be any business of the Corporation, including but not necessarily limited to: notices of meetings; notices of services upcoming (such as parkade cleaning, window washing, painting projects, etc.); notices of service interruptions (such as water shut off or power shut off to facilitate repairs or maintenance), regularly recurring business (such as the annual budget and manager’s report); newsletters and individual notices to owners (such as bylaw infractions, pet approvals and arrears notices);
  • You are providing your email address(s) to PEKA and to the Condominium Corporation in which you are a member, both jointly and severally; 
  • This change in service will not take effect until the final passing and proclamation of the Condominium Property Amendment Act.  Until this time, you may continue to receive notices from the Corporation via regular mail.  You may also receive some notices (depending on the nature of the notice) via email.
  • You are the registered owner, or authorized agent on behalf of the registered owner, and have full right and authority to authorize this change in method of service for Corporation business;
  • All information you have provided is complete, truthful and accurate;
  • PEKA and the Corporation take no responsibility for the following:
    • Emails returned as undeliverable, whether notification of the same is provided and regardless of the reason;
    • Emails, or a portion of the content of an email (including an attachment(s)) not reaching the intended party for circumstances beyond PEKAs control (for example, if the sender or recipient internet service is disrupted during transmission; size restrictions of the recipients email account or if the recipient has intentionally or unintentionally blocked PEKAs domain for any reason)
    • Emails being marked as spam or automatically routed to a ‘junk’ email folder;
    • The addition of an email address(s) or the removal of an email address(s) as instructed by you or anyone claiming to be you or an authorized agent acting on behalf of the unit owner(s) provided information PEKA receives is in keeping with the Corporations current owner records;
    • Loss or damage as the result of our email correspondence or attachments.
    • The accuracy and completeness of information contained in email messages as a result of circumstances beyond PEKAs control.  Although every reasonable effort is made to ensure that condominium notices are complete and accurate, errors and omissions, although unlikely, are possible.  Therefore, all correspondence from PEKA or the Corporation should be considered E. & O.E., regardless of the method of service;
  • You will notify PEKA promptly of any change to your contact information, including but not limited to your email address(s), and you acknowledge that changes to your contact information may take up to 15 days to take effect;
  • You will not redistribute Corporation business to any third party without first obtaining written consent from the Corporation;
  • You can cancel your consent to receive email notices at any time.  Upon processing, (which may take up to 15 days to complete), your regular mail service will recommence.  To opt out of email service, please email info@peka.ca.
  • Service of Corporation notices (regardless of method served) will stop automatically upon written notice to PEKA that you have sold or otherwise disposed of your condominium unit, effective the intended date of transfer.  

PEKA will not sell or otherwise distribute your email address(s) to third parties for any reason.

PEKA will not use your email address to distribute Commercial Electronic Messages as described in Canada’s Anti-Spam laws, however, PEKA holds no responsibility for the content of email messages you may be sent directly from the Corporation.

You agree to indemnify and save harmless PEKA, its agents, servants and employees of and from all loss, cost, damage, expense, or liability whatsoever, which may be imposed on them, or any one of them, by reason of any present or future violation or alleged violation of any of the above terms or any term which may not be specifically noted herein but would otherwise be an implied term of this Agreement.
